On this basis, the high court overturned the family court decision. The court did not, however, order that the child be immediately handed over to the birth mother as she had asked. It merely said, rather vaguely, that if there was a real problem, then the CGC could follow procedures to resolve it.

The child guidance centre conducts a home study and then passes its recommendation on the couple, first to the office of the governor for a rubber-stamp approval, and then to the Child Welfare Council which will almost certainly accept the advice of the CGC. An approved couple are then able to register as foster parents and attend an information meeting. In a parallel process, the couple’s future child is identified as eligible for adoption by the CGC in consultation with the children’s home or infant home that is caring for the child.
